Agreement to Terms ​

By downloading, installing, accessing, or using MockKit (the "App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use the App.

Description of Service ​

MockKit is a mobile application for creating device mockups from screenshots and images. The App includes features such as image import, frame/styling options, and high-quality export and sharing tools.

Eligibility ​

You must be at least 13 years old to use the App. By using the App, you represent and warrant that you are at least 13 years of age and have the legal capacity to enter into these Terms.

User Responsibilities ​

You agree to:

  • Use the App only for lawful purposes and in accordance with these Terms
  • Maintain the security of your device and local data
  • Not attempt to gain unauthorized access to the App or its related systems
  • Not use the App to transmit any malicious code, viruses, or harmful content
  • Not reverse engineer, decompile, or disassemble the App
  • Not copy, modify, or create derivative works of the App

Intellectual Property Rights ​

Our Rights ​

  • The App, including its design, features, functionality, and content, is owned by us and protected by copyright, trademark, and other intellectual property laws.
  • All rights not expressly granted to you are reserved by us.

Your Content ​

  • You retain ownership of screenshots, images, and other content you import or create using the App.
  • You are responsible for ensuring you have the necessary rights to use, edit, and export the content you process in the App.
  • We do not claim ownership over your content.

Acceptable Use ​

You agree not to:

  • Use the App in any way that violates applicable laws or regulations
  • Interfere with or disrupt the App or servers connected to the App
  • Use automated systems or scripts to access the App without permission
  • Impersonate any person or entity or misrepresent your affiliation with any person or entity
  • Use the App for any commercial purpose without our express written consent
  • Use the App to infringe third-party intellectual property, privacy, or publicity rights

Service Availability ​

  • We strive to provide reliable service but do not guarantee that the App will be available at all times or free from errors.
  • We reserve the right to modify, suspend, or discontinue the App or any part thereof at any time with or without notice.
  • We are not liable for any loss or damage resulting from the unavailability of the App.

Data and Privacy ​

  • Your use of the App is also governed by our Privacy Policy, which is incorporated into these Terms by reference.
  • You are responsible for backing up your content and exports. We are not responsible for any loss of data.

Third-Party Services ​

The App may integrate with third-party services, including but not limited to:

  • App Store: For app distribution and updates
  • iOS Platform Services: For permissions and system share/export functionality

Your use of these third-party services is subject to their respective terms of service and privacy policies.

In-App Purchases and Subscriptions ​

If the App offers in-app purchases or subscriptions:

  • All purchases are processed through the App Store and subject to Apple's terms and conditions
  • Prices are subject to change without notice
  • Refunds are subject to Apple's refund policy
  • Subscriptions will automatically renew unless cancelled at least 24 hours before the end of the current period

Disclaimer of Warranties ​

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

WE DO NOT WARRANT THAT:

  • THE APP WILL MEET YOUR REQUIREMENTS
  • THE APP WILL BE UNINTERRUPTED, TIMELY, SECURE, OR ERROR-FREE
  • THE OUTPUTS GENERATED BY THE APP WILL BE SUITABLE FOR EVERY USE CASE OR PLATFORM
  • ANY ERRORS IN THE APP WILL BE CORRECTED

Limitation of Liability ​

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, OR USE, ARISING OUT OF OR RELATING TO YOUR USE OF THE APP, REGARDLESS OF THE THEORY OF LIABILITY.

OUR TOTAL LIABILITY TO YOU FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THE USE OF THE APP SHALL NOT EXCEED THE AMOUNT YOU PAID FOR THE APP, IF ANY.

Indemnification ​

You agree to indemnify, defend, and hold harmless us, our affiliates, and their respective officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, costs, or expenses (including reasonable attorneys' fees) arising out of or relating to:

  • Your use of the App
  • Your violation of these Terms
  • Your violation of any rights of another party
  • Your content or data

Termination ​

Termination by You ​

You may stop using the App at any time by uninstalling it from your device.

Termination by Us ​

We may terminate or suspend your access to the App immediately, without prior notice, to the extent permitted by law, including but not limited to:

  • Your violation of these Terms
  • Your fraudulent, abusive, or illegal activity
  • Requests by law enforcement or government agencies
  • Technical or security issues

Upon termination, your right to use the App will cease immediately.

Changes to Terms ​

We reserve the right to modify these Terms at any time. We will notify you of any material changes by:

  • Posting the updated Terms on this page
  • Updating the "Last Updated" date
  • Providing notice through the App (if applicable)

Your continued use of the App after such modifications constitutes your acceptance of the updated Terms.

Governing Law and Dispute Resolution ​

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction where we are established, unless mandatory consumer protection laws in your place of residence apply.

Dispute Resolution ​

Any disputes arising out of or relating to these Terms or the App shall be resolved through:

  1. Good Faith Negotiation: The parties agree to attempt to resolve disputes through good faith negotiation.
  2. Mediation: If negotiation fails, disputes may be submitted to mediation.
  3. Arbitration or Litigation: As applicable under governing law and mandatory local legal requirements.

Severability ​

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.

Entire Agreement ​

These Terms, together with our Privacy Policy, constitute the entire agreement between you and us regarding the use of the App and supersede all prior agreements and understandings.

Waiver ​

No waiver of any term or condition of these Terms shall be deemed a further or continuing waiver of such term or condition or any other term or condition.
